Although the Internet is frequently referred to as a global public resource, its functioning remains predominantly controlled by private actors. The Internet brought about significant shifts in the way we conceptualize governance. In particular, the handling of “big data” by private intermediaries has a direct impact on routine practices and personal lives. The implementation of the “right to be forgotten” following the May 2014 decision of the Court of Justice of the European Union against Google blurs the boundaries between the (...) public and the private, and extends the responsibilities of the latter to court-style decision making. This article analyzes the regulatory developments in this area and the implications of outsourcing of important governance practices to private intermediaries. It looks at the decision-making process for the “right to be forgotten” to illustrate the extent to which the hybridization of such procedures results in new arrangements between public and private ordering in Internet governance. According to some views, natural language suffers from underdeterminacy, but thought doesn’t. According to the underdeterminacy claim, sentence types underdetermine the truth-conditions of sentence tokens. In particular, the semantics of a predicate type seems to underdetermine the satisfaction conditions of its tokens. By contrast, mental representation-types are supposed to determine the truth-conditions of its tokens. In this paper I critically examine these mixed views. First, I argue that the arguments supporting the indispensability of including in one’s theory mental representations that (...) are free of the underdeterminacy exhibited by natural language are not sound. As a result, the possibility that mental representation-types are as underdetermined as natural language sentence-types has not been ruled out. Second, I argue that Carston’s ad hoc concept-types are as underdetermined as word-types. I finish by arguing that mental representations are also underdetermined in a second sense—mental representation-tokens only determine a partial function from possible worlds to truth-values. Lara Buchak sets out a new account of rational decision-making in the face of risk. She argues that the orthodox view is too narrow, and suggests an alternative, more permissive theory: one that allows individuals to pay attention to the worst-case or best-case scenario, and vindicates the ordinary decision-maker.

This paper argues against the priority of temporality over spatiality, which Heidegger defends in Being and Time . The argument, however, does not follow the turn in Heidegger's philosophy and his later retrieval of the spatial but is developed as a delimitation—that is, as an internal critique and reconstruction—undertaken within the transcendental framework of his early thinking. This delimitation proposes a demonstration of the fundamental role of spatializing, defined as dissemination, in the constitution of human Being-in-the-world. A rethinking of human (...) Being-there in terms of the co-originality of spatiality and temporality permits a revisiting of the question of the transcendental and makes it possible to pursue the overcoming of a philosophy of the subject that, critics often point out, Heidegger unsuccessfully sought to transgress in his early work. It is sometimes said that faith is recalcitrant in the face of new evidence, but it is puzzling how such recalcitrance could be rational or laudable. I explain this aspect of faith and why faith is not only rational, but in addition serves an important purpose in human life. Because faith requires maintaining a commitment to act on the claim one has faith in, even in the face of counter-evidence, faith allows us to carry out long-term, risky projects that we (...) might otherwise abandon. Informed consent may be unobtainable in online contexts. This article examines the difficulties of obtaining informed consent online through a Facebook case study. It is proposed that there are at least two ways informed consent could be waived in research: first, if the data are public, and second, if the data are textual. Accordingly, the publicness of the Facebook News Feed is considered. Taking account of the wide availability of Facebook users’ data, and reflecting on how public those users perceive (...) their information to be, this paper argues that some Facebook data are properly viewed as public to semi-public in nature. A second issue is whether the Facebook News Feed data collection ought to be classified as document-based or human subjects research. Since the Facebook News Feed involves social interaction that may elicit ‘ethically important moments’, this paper proposes that observing it may constitute human subjects research. While informed consent is desirable for human subjects research, it is suggested that Facebook News Feed observations are comparable to observational research in a public space, and thus waiving informed consent in this online setting could be justifiable. It can be said that the concept of vulnerability is crucial for the understanding of health and wellbeing. Wellbeing has been taken to be at the core of the concept of health (as the World Health Organisation also defines it). In this paper, I suggest that a proper understanding of health and wellbeing should start with an investigation of vulnerability and ill health and, in particular, the lived experience of these aspects of the human condition. The lived experience of vulnerability (...) and, in particular, ill health involves physical, mental and social suffering as well as experiences of wrongs, harms and injustices which are often rooted in certain misconceptions and myths about vulnerability, illness and mental ill health. I argue that dominant notions of ‘vulnerability’, ‘health’, ‘wellbeing’ are not only unclear but unrealistic and ethically problematic. This paper seeks to expose some of these limitations and, at the same time, offers a contribution to the clarification of the concepts at issue. The aim is to develop a more inclusive and realistic conception of health and wellbeing which, in its turn, can help promote life-enhancing possibilities to be and to live well in health or illness. The basic plan of the paper is this: I discuss two concepts of vulnerability, and point out certain limitations of dominant approaches to them. I offer an alternative understanding of these two concepts of vulnerability, and of the relation between them. I apply this analysis to certain discussions concerning illness and mental health in order to identify life-enhancing possibilities of vulnerability that constitute resilient wellbeing and are conducive to health. As part of this discussion, I point out the social, relational and intersectional aspects of vulnerability, resilient wellbeing and health, and indicate how the approach I propose can contribute to current ethical and political discussions about these issues. Many classical approaches in the area of phenomenological pscyhopathology focus on structures of lived experience of mental illness and overlook the role social context plays in the formation of lived experiences. The paper addresses this issue and contributes to recent research which has pointed out that there is a need for an approach to mental health which investigates the role of context in shaping lived experiences. We propose a conception of contextuality (or situatedness) which we develop in terms of two (...) main characteristics: intersectionality and social relationality of the human condition. We take context to be shaped by social interdependence and by the intersection of multiple factors including gender, race, ethnicity, class, socio-economic status and power relations. We develop this analysis in relation to substance misuse, refer to, and compare, certain case studies and perspectives from Brazil to illustrate our approach which can, however, be applied to other areas of mental health. We suggest that the proposed contextual approach is crucial for an in-depth understanding of psychopathology from a phenomenological perspective and in relation to contemporary ethico-political issues concerning social differences and inequalities in mental health. This paper takes issue with Heidegger's claim that discourse and understanding are equally basic in the constitution of our making sense of the world. I argue that Heidegger cannot consistently establish this claim, and that discourse can be thought of as being more basic than understanding. The proposed line of thinking has the advantage of shedding light on both the finitude and the normativity of our making sense of the world. Thus, by setting up an exchange with the later Wittgenstein's (...) discussion of rule-following makes it possible to develop an approach to the normativity of meaning which was not readily available on Heidegger's account. Further, the paper offers an inquiry into a certain aspect of our finite sense of the world which, in spite of Heidegger's marked attention to finitude, was obscured by his approach to discourse. The implications of the argument might be far-reaching. The view of a basic role of discourse can put into question Heidegger's guiding vision according to which time alone is ultimately the fundamental constituent of our sense of what there is. The engagement with Wittgenstein indicates, in conjuction with other themes of the paper, that there are certain perspectives and issues in phenomenology which are much closer to aspects of the analytic tradition than is usually granted. The paper brings existential temporality, as developed in the work of phenomenologists Merleau-Ponty, Heidegger, and Husserl, into dialogue with historical materialism. What results is the development of a theoretical background for what the author terms futural materialism, which is taken to be a complimentary logical extension of historical materialist projects. To this end, it is suggested that the past and the future are best understood as materially existing in the present in an immanent way, mediated by conscious beings in the (...) form of memory, projection, residual effect, and affect. Put differently, the present's presence in the past and future play a determining roll in those temporal dimensions, which subsequently fold back into the configuration of the present. Following Nietzsche and drawing influence from Guattari and Deleuze, it is argued that past and future are relatively fluid tools to be purposively deployed in the present for particular purposes rather than being transcendent facts which subjectivity must merely contend with. It is further asserted that as part of a broader non-reductive material monist project of social transformation, both futural and historical materialism are necessary considerations. (shrink)

The origins of teacher training programs in Chile have not been addressed in depth apart from Vivanco’s studies. Even though these studies explore the development of these programs in Chile from a chronological perspective, there are no qualitative studies that consider senior academics’ narrations. This qualitative study reconstructs the trajectory of teacher training programs in Chile from a series of interviews with 25 academics in charge of these programs. Results were analyzed in three different periods: 1960-1973, 1973-1990, and 1990 to (...) 2019. Results, discussed in a political and academic context, reveal that these teacher training programs have evolved in a sociopolitical context, generating a series of tensions that substantially impact these training programs. The study finishes with the statement of a series of questions aimed at reflecting upon the state of the art in Chile’s training programs. (shrink)

This article explains the connection between work and life. In order to be able to understand the concept of work and its meaning for life in detail, the design possibilities of the work must first be explained and put into context with free time. It shows that work, as the basis of food production and livelihood, is the crucial factor in the lifeworld and thus strongly influences the life forms of society, since work shapes social values. For this analysis, it (...) is therefore essential to examine the changes in the values of modern society in the course of changing forms of work. The aim of this study is to show that the more radically the forms of work undergo change, the greater the change in values. Finally, it will be discussed what significance this changed nature of work and values has for today’s society. (shrink)

My book Risk and Rationality argues for a new alternative to the orthodox theory of rational decision-making. This alternative, risk-weighted expected utility maximization, holds that there are three important components involved in rational decision-making: utilities, probabilities, and risk-attitudes. This essay explains the basic outline of the theory and precisely how it differs from the orthodox theory. It also summarizes the main threads of argument in the book.

To perform an illocutionary act – e.g. to apologise – is it necessary, sufficient, or irrelevant that a hearer understand you to be performing that act? This issue is sometimes called the ‘problem of uptake’. Famously, Austin’s inaugural account makes uptake necessary for illocutionary force. For decades, critics have objected to this view: Some have sought to show that uptake is irrelevant; others have argued that uptake is important though not essential; while still others have argued that uptake is necessary (...) though must be radically reframed. Nevertheless, it is widely agreed that there is a problem of uptake in Austin. In this paper, I contend that this view is wrong. Austinian uptake, I argue, is essential; yet, contra the standard reading, it is not synonymous with understanding. Uptake is a narrow criterion pertaining to conventional-linguistic competencies, which rules out specific kinds of misunderstanding, not misunderstanding überhaupt. The importation of non-Austinian assumptions about uptake from subsequent speech act theorists – specifically, the mis-equivocation of uptake with understanding a speaker’s intention – I show, has muddied the water. This paper offers a novel reconsideration and salvaging of uptake and its significance, whose stakes I elucidate through intervention in the fraught issue of conceptualising sexual consent. (shrink)

This paper provides an account of what it is to have faith in a proposition p, in both religious and mundane contexts. It is argued that faith in p doesn’t require adopting a degree of belief that isn’t supported by one’s evidence but rather it requires terminating one’s search for further evidence and acting on the supposition that p. It is then shown, by responding to a formal result due to I.J. Good, that doing so can be rational in a (...) number of circumstances. If expected utility theory is the correct account of practical rationality, then having faith can be both epistemically and practically rational if the costs associated with gathering further evidence or postponing the decision are high. If a more permissive framework is adopted, then having faith can be rational even when there are no costs associated with gathering further evidence. (shrink)

This paper examines Kant's accounts of friendship and marriage, and argues for what can be called an ideal of “moral marriage” based on Kant's notion of moral friendship. After explaining why Kant values friendship so highly, it gives an account of the ways in which marriage falls far short, according to Kant, of what friendship has to offer. The paper then argues that many of Kant's reasons for finding marriage morally impoverished compared with friendship are wrong‐headed. The paper further argues (...) that a few of Kant's views about friendship are false. The main point is that, when we slightly revise Kant's account of friendship and jettison Kant's misguided notions about marriage, we see that marriages can aspire to much of the same moral richness as friendships. Finally, the paper argues that this friendship model of marriage does not obscure the important ways in which marriages and friendships differ. (shrink)

This essay argues that when setting climate policy, we should place more weight on worse possible consequences of a policy, while still placing some weight on better possible consequences. The argument proceeds by elucidating the range of attitudes people can take towards risk, how we must make choices for people when we don’t know their risk-attitudes, and the situation we are in with respect to climate policy and the consequences for future people. The result is an alternative to the Precautionary (...) Principle, an alternative that gives similar policy recommendations in many cases but is also sensitive to the costs of precautions. (shrink)

Curricular design that addresses residency physician competencies in communication skills and professionalism remains a challenge. Graphic Medicine uses comics, a medium combining text and images, to communicate healthcare concepts. Narrative Medicine, in undergraduate medical education, has limited reported usage in Graduate Medical Education. Given the time constraints and intensity of GME, we hypothesized that comics as a form of narrative medicine would be an efficient medium to engage residents.The authors created a novel curriculum to promote effective communication and professionalism, focusing (...) on empathy, compassion and cultural competency. A four-week curriculum was delivered in a neurology residency program. Excerpts from non-fiction graphic memoirs about neurological conditions were read, discussed, and paired with prompt-driven drawing exercises. Qualitative surveys were used to assess acceptability of comics, usefulness of comics to convey patient illness experience, and perception of patient needs for physician-patient communication.Ninety-seven percent of residents reported the sessions were a good use of their time. Residents identified new symptoms of neurologic disorders, articulated patient communication needs, and expressed increased empathy after participation. Residents participated in drawing exercises, but these were not formally analyzed. Graphic medicine is a well received format that may build communication skills and increase empathy. (shrink)

Raising awareness of the environmental impact of energy generation and consumption has been a recent concern of contemporary society worldwide. Underlying the awareness of energy consumption is an intricate network of perception and social interaction that can be mediated by technology. In this paper we argue that issues regarding energy, environment and technology are very much situated and involve tensions of sociocultural nature. This exploratory investigation addresses the subject by introducing the design of a Socially-inspired Energy Eco-Feedback Technology, which is (...) composed of an interactive system to trigger and mediate collective savings and a tangible device as a public feedback. Results of an evaluation situated in the context of a school in a socially disadvantaged area in Brazil are discussed, shedding light on the sociocultural aspects related to the subject. The role of the SEET to motivate energy awareness collectively among the social group is assessed, as well as the design characteristics that contributed to that. Outcomes bring to light social aspects and dynamics that would hardly have been predicted, evidencing critical factors related to a socially inspired design approach in the energy awareness domain. A positive reconceptualization of vulnerability involves a number of levels of inquiry; arguably, a fundamental or, at least, central level is the phenomenology of vulnerability with which I am concerned in my paper. By drawing on existential phenomenology and by engaging with Pamela Sue Anderson’s positive account of vulnerability, I develop a phenomenological conception of vulnerability as “openness” and pursue it in new directions which connect it to the metaphysics and epistemology of vulnerability. This approach brings to the fore the (...) possibility of resilience in the face of serious adversities which affect our lives, and draws some ethical implications in relation to this. I engage with recent work in the area of the phenomenology of illness to elaborate certain parts of the investigation. (shrink)

There are currently two robust traditions in philosophy dealing with doxastic attitudes: the tradition that is concerned primarily with all-or-nothing belief, and the tradition that is concerned primarily with degree of belief or credence. This paper concerns the relationship between belief and credence for a rational agent, and is directed at those who may have hoped that the notion of belief can either be reduced to credence or eliminated altogether when characterizing the norms governing ideally rational agents. It presents a (...) puzzle which lends support to two theses. First, that there is no formal reduction of a rational agent’s beliefs to her credences, because belief and credence are each responsive to different features of a body of evidence. Second, that if our traditional understanding of our practices of holding each other responsible is correct, then belief has a distinctive role to play, even for ideally rational agents, that cannot be played by credence. The question of which avenues remain for the credence-only theorist is considered. (shrink)

This article explores the queer qualities of feminist scientist Donna Haraway's ‘A Cyborg Manifesto’. In the first part, the article investigates the similarities between ‘A Cyborg Manifesto’ and the ideas circulating in queer theory, including the hybridity of identity, and the disruption of totalizing social categories such as ‘Gay man’ and ‘Woman’. In the second part, it is argued that ‘A Cyborg Manifesto’ evinced a decolonial feminist form of queerness. The article references the African-American, Chicana and Asian-American feminist sociology, theory, (...) literature and history that ‘A Cyborg Manifesto’ takes up. The article does not wish to position Haraway's white-authored text as an authoritative voice on decolonial feminist queerness, instead arguing for the role of ‘A Cyborg Manifesto’ as a bibliographical work that readers may reference in their exploration of decolonial feminist beginnings of queer theory. In this paper I argue that, on Kant's view, the work of genius serves as a sensible exhibition of the Idea of the highest good. In other words, the work of genius serves as a special sign that the world is hospitable to our moral ends and that the realization of our moral vocation in such a world may indeed be possible. In the first part of the paper, I demonstrate that the purpose of the highest good is not to (...) strengthen our motivation to accept the moral law as binding for us but, rather, to strengthen our motivation to persist in our already existent moral dispositions. In the second part, I show that the works of genius exhibit the Idea of the highest good and, consequently, strengthen our hope in its realization. Drawing on the results of the second part, the third part of the paper demonstrates that beauty, of both art and nature, symbolizes morality in a more substantive sense than that suggested by Henry Allison's “formalistic” interpretation. Since, on my view, fine art in Kant serves as a sensible representation of an undetermined conceptual content, or the Idea of the highest good, the fourth part of the paper addresses the vexed question of whether Kant's account of fine art already anticipates the cognitive role later attributed to it by the German Idealists. Some Kantian ethicists, myself included, have been trying to show how, contrary to popular belief, Kant makes an important place in his moral theory for emotions–especially love and sympathy. This paper confronts claims of Kant that seem to endorse an absence of sympathetic emotions. I analyze Kant’s accounts of different sorts of emotions (“affects,” “passions,” and “feelings”), and different sorts of emotional coolness (“apathy,” “self-mastery,” and “cold-bloodedness”). I focus on the particular way that Kant praises apathy, as “sublime,” in order (...) to argue that his praise of extreme emotional self-control is not incompatible with, but rather complementary to, his praise of sympathy. Responding to growing interest in the Kantian tradition and in issues concerning space and time, this volume offers an insightful and original contribution to the literature by bringing together analytical and phenomenological approaches in a productive exchange on topical issues such as action, perception, the body, and cognition and its limits.

In this paper, I am concerned with certain phenomenological contributions to person-centred practices in healthcare. I propose a meaning-centred phenomenological approach to illness and contrast it with certain body-centred and feeling-centred accounts. I suggest that the proposed approach complements, rather than competes with, these other accounts in the area of phenomenology of illness. This is illustrated, for example, by the way the proposed meaning-centred approach tackles certain general challenges to the phenomenology of illness. I pursue this approach to develop an (...) account of illness as involving a loss of meaning. However, I point out that at the heart of illness lies the possibility of resilience. Resilience is existentially understood as enacting a reconstruction of meaning. I point out that resilience and certain related cognitive mechanisms make well-being possible. Here, to be well is existentially understood as being able to find meaning in life. The phenomenological analysis of existential resilience and well-being I offer in this paper indicates that resilient ways of being which enable well-being can be learned; the analysis thus brings to light deep motivations for supporting resilient learning through healthcare practices and policies. This study addresses the current lack of empirical data on the experiences and attitudes of clinical research professionals towards AI-powered clinical trial management tools. Clinical research professionals affiliated with various Swiss and international clinical research networks were invited to participate in an online survey. The survey focused on nine use cases of AI-powered clinical trial management tools. Participants were asked to share their ethical considerations, and their experiences were assessed at both the individual and institutional levels. Answers from 110 participants, (...) primarily from Swiss academic institutions, were included in the data analysis. While participants generally held positive attitudes, mixed views were also common. Governmental attitudes were widely perceived as unclear or cautious, with the associated regulatory opacity possibly contributing to the limited adoption of AI in trial management observed in this study. In addition to a clear AI governance, ethical compliance and training emerged as crucial aspects. There was also broad consensus on the necessity of informing patients about tools’ uses and of ensuring an independent certification of the respective tools. The widespread adoption of AI-powered clinical trial management tools remains distant, entangled in a net of complexities that require further empirical investigation. Ethical concerns appear to play a crucial role, driven by distrust and the absence of a clear regulatory framework. Urgent actions are needed at both institutional and governmental levels, including the establishment of a governance framework and training provision. (shrink)

Atlas Mnémosyne. Le monstre apparaît alors non comme un innommable qui résiste à la rationalité mais comme un des points d’appui du sujet rationnel dans son effort pour élaborer un espace de pensée.
